The Court Appeal (CoA) has upheld the decisions of the Employment Tribunal (ET) in Asda V Brierly and others, where Asda supermarket staff (checkout and other customer-facing roles), in their majority women, are able to compare themselves to distribution staff, mostly male, based at depots or warehouses with the purposes of an equal pay claim.
This decision has sparked thousands of women employed by Morrisons to file a legal case arguing female and male shop workers should receive the same pay for in-depot roles.
